Would this just be considered a cover song? I mean he's letting people download it for free, but he isn't listing original artists or getting permission to distribute it.

not a cover song but definitely a sample
and who knows what the people who control the rights to the song have given permisson to do
i know i've been hearing this song on all sorts of commercials since the song came out
so who knows
